1. The service

Healup is an AI-assisted health and fitness companion developed and operated by Web Ninja Solutions Private Limited ("Healup", "we", "us", or "our"). The service includes the Healup mobile application for iOS and Android and any associated websites or APIs.

Healup helps you log meals by camera, track macros and exercise, and view nutrition trends. Healup is for general wellness only. It does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before making significant changes to your diet, exercise routine, or medication.

2. Eligibility

You must be at least 16 years old to create a Healup account (or the minimum age required to enter into a binding contract in your country, whichever is higher). If you are between 16 and 18, you confirm that you have your parent's or legal guardian's permission to use Healup.

By creating an account, you represent and warrant that you meet these age requirements and that all information you provide is accurate.

3. Your account

• You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.
• Notify us immediately at contact@webninjasolutions.com if you suspect unauthorised access.
• You may not share your account or transfer it to another person.
• You may not create accounts in an automated manner or create multiple accounts to circumvent restrictions.

4. AI features and accuracy

When you scan a photo of food, Healup sends a low-resolution copy to OpenAI for food identification. The resulting nutritional values are estimates only. Actual calorie and macro content depends on portion size, preparation method, ingredient brand, and other factors that Healup cannot verify.

Healup does not guarantee the accuracy of any AI-generated nutritional estimate. You should treat all values as approximate guidance and consult a registered dietitian or other qualified professional for precise dietary advice.

5. Subscriptions and free tier

5.1 Free tier

The free tier of Healup includes up to 3 AI food scans per day, manual meal logging, calorie and macro tracking, water and exercise logging, and basic barcode scanning. The free tier is available indefinitely at no cost.

5.2 Premium subscription

Healup Premium is available as a monthly auto-renewing subscription at the price displayed on the in-app paywall and in the Apple App Store / Google Play listing at the time of purchase. Pricing may vary by country.

• Free trial: A 7-day free trial is available to new Premium subscribers. Your subscription will begin and your payment method will be charged at the end of the trial period unless you cancel before the trial ends.
• Auto-renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before renewal.
• Cancellation: Manage or cancel your subscription through your Apple ID or Google account settings. Healup cannot cancel subscriptions on your behalf.
• Price changes: We will notify you of any price changes in advance. Continued use after the effective date constitutes acceptance.

6. Refunds

All purchases and subscriptions are processed by the Apple App Store or Google Play. Refunds are subject to the respective store's refund policy. Healup cannot issue refunds directly for store-managed purchases. Please refer to our Refund Policy and contact Apple or Google support to request a refund.

7. Acceptable use

You agree not to:

• Reverse-engineer, decompile, or disassemble the app or its underlying technology.
• Use automated tools to scrape, crawl, or overload our systems.
• Attempt to gain unauthorised access to other users' accounts or data.
• Upload or transmit harmful, illegal, defamatory, or infringing content.
• Impersonate any person or entity.
• Use Healup in any way that violates applicable laws or regulations.
• Resell, sublicense, or otherwise commercialise the app or its outputs without our written permission.

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

8. Intellectual property

Healup, its logo, design, software, and content are owned by Web Ninja Solutions Private Limited and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the app for your personal, non-commercial purposes.

Your personal data (meal logs, photos, notes) remains yours. By using Healup, you grant us a limited licence to process that data solely to provide the service to you.

9. Third-party services

Healup integrates with third-party services including Apple Health, Google Health Connect, OpenAI, Supabase, RevenueCat, and others. Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the actions, content, or availability of third-party services.

10. Health disclaimer

Healup is a general wellness tool. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition. The information provided by Healup should not be used as a substitute for professional medical advice, diagnosis, or treatment. See our full Health Disclaimer.

11. Termination

You may delete your Healup account at any time via Profile → Settings → Delete account. Deletion is permanent and irreversible — all your data will be erased from our servers within 30 days.

We may suspend or terminate your account if you violate these Terms, if we are required to do so by law, or if we discontinue the service. We will endeavour to give reasonable notice where possible.

12. Disclaimers

Healup is provided "as is" and "as available". To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or completely secure.

13. Limitation of liability

To the maximum extent permitted by applicable law, Web Ninja Solutions Private Limited's total liability arising out of or relating to these Terms or the service will not exceed the greater of: (a) the total amount you paid to Healup in the 12 months preceding the claim, or (b) USD $50.

In no event will we be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, even if we have been advised of the possibility of such damages.

14. Indemnification

You agree to indemnify and hold harmless Web Ninja Solutions Private Limited and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of Healup, your violation of these Terms, or your infringement of any third-party rights.

15. Changes to these terms

We may update these Terms from time to time. We will notify you via in-app notice or email at least 14 days before material changes take effect. Continued use of Healup after the effective date constitutes your acceptance of the revised Terms. If you do not agree, please stop using the app and delete your account.

16. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any disputes arising under these Terms shall first be attempted to be resolved amicably. If that fails, disputes shall be subject to the exclusive jurisdiction of the courts of India.

If you are a consumer resident in the EU or UK, you also have the right to bring claims in the courts of your country of residence.
